View Full Version : need advice on what to do about a big ticket

Now, I realize that this isn't MY BNZSport car, but a buddy of mine is in need of help. He was driving back from my house one night taking a friend home, going approx. 90 mph on the 3-lane highway at 3AM, and noticed lights following him. He thought it was someone trying to ride off of his his radar detector protection, so he punched it. (For those of you needing a mental picture, it's a 2001 BMW 325Ci) He takes it up to about 120, then lets it off. . . enough to put much more of a gap between this pansy-speeder. About a minute later, he notices that that car is coming up on him now, and when it get close, lights start flashing and he realized he just blew away a cop. To shorted the story, the ticket said he was paced at 90 for 1/2 mile and reached a top speed of 130. (Now, he knows he wasn't going that fast, because he didn't hit the limiter which is at 128). Any advice for him? Thankfully, the police officer did not give him reckless endangerment (because of the speed and the passenger) which would've meant he would've gone directly to jail, and not passed GO. He's talking about getting a lawyer, and trying to get them to lower the speed by making as good a case as possible that he was not going 130 mph. We'll see what happens. Hang in there, SimSima325.

He needs a lawyer on this one. A ticket like that can mess you up for years to come. See if they can just let him out with a point on his record, because as it looks right now, he is facing a 3 or 4 point ticket.

tell some story...that its 3 am and u were followed by this car non stop, who was stocking you, and then on the highway you taught it was him again...you have better things to do then to run away from cops

not 3-4 points, this is PA. 4 points is up to 23 over. . . 130 he will lose his license for a year if it isn't SERIOUSLY reduced.
I was thinking of the story thing too. something like: the was a road rage incident earlier on the road, and he had to book it to get away, and then the lights following made him think the guy was back. That , in with the fact that the speed on the ticket is faster than the limiter on the car, and the first-offense that speed thing, I thought could give him a shot. We shall see. . . he hasn't even told his parents yet. :dead::ninja:

Stalking, not stocking.
And you're followed by cars nonstop everyday on the freeway. Waht the hell did you want the car to do? Stop?
As the excuse to NOT give to the judge "I thought he was trying to ride off of my radar detector," if you venture into trying this...you gonna get bitched slapped.
Who gives a damn if he's trying to "ride the radar."
And at night, you should know better than speeding when you see someone speeding faster than you...
Anyway, today I Got on the on ramp at 85mph, cut off a van, and...popo was right behind, about 100ft behind the van, and I didn't see him. When I finally saw him, I hit the brakes down to 70 and stayed there, he passed me, and I followed him, and nothing. Why? Cuz he was sheriff and had no radar in the car (not a traffic enforment deputy).

wouldn't your radar detector have gone off if he clocked you at 130 or so??
I guess I don't see any issue here. Adult driver doing 90 mph at 3 a.m. then takes it up to 128-130 mph on public road. The dispute is over 2 mph? What am I missing here? Does your friend need a lawyer to say "guilty"?
As for pitching some story about road rage, is he going to be a liar and a weasel to avoid taking responsibility?

he said it was night at 3am...so i dont think that there would be that many cars on the highway

He must have an awsome radar dector that couldnt detect a cop right behind him. :D
Best thing to do is get a lawyer and just lie about the whole thing.
Say he was going 90 and went up to about 100 and then got pulled over. Use the fact that the car isn't capable of 130 as a defense. This is court, you can get away with murder if you lie just right.

i think the post says he was paced from 90 and up.....which would explain the no radar?

when cops start lying that you were doing faster than your car can do that is just rediculous...i knew this one guy who drove a caddy, top speed 85mph..the governer does not let him go past 90 i believe or is it 85, anyways, the cop lied that he did 120 on a highway, when in fact he did not even have a radar detector on him, and he got busted for lying.

Even though Im only a "po po" part time here in Illinois, I still have the same powers and training as a full timer( I used to be full time but thats another story LOL). Your best bet is to get a lawyer and plead the case as not guilty so it goes to trial. Here in Illinois if the officer doesn't show up the case is thrown, and if he/she does its best to talk to the prosecutor first and plead your case with him(lawyer in hand of course!) before the case begins. The state would rather not got to court and waste time and is more apt to reduce the ticket to whatever and get a guilty plea and have a fine assessed. Tell the attorney the truth on what you did, they have experience with the prosecutors and know how to work with them, by no means do you get an out of county or city lawyer, your case WILL be heard then and a conviction is more likely. I have not lost a case yet in my 6 years but Im not a traffic cop so much. (my pet peaves however are DUIs and kids not in safety belts) I wont write someone for things I do(ie driving 15-20 over). Hope this helps, again though this is how is works in Illinois.

Well is diff in every state. in CA if you get a tick on the freeway for over 100mph then they can throw you in jail but ususally they dun.
i got a tic for going 101mph (5 yrs ago) actually i was doing a lot more than that probably 125mph but the popos there were (notice 'were' aka 'multiple popo') gave it to me at 101
so it was 2 pts of my record and one month of lis suspension and hell raised in insurance

talk about insurance, i got a ticket at 2 am with NO cars around me whats so ever, for not using a turning signal...insurance increased $35 for me per month....STATE FARM sucks ass...they will try to rip you off anyway they can

Last year in December I was going down the 5, near the bakersfield area and decided to see how fast I could see my car could go. So at around 140 I see a cop coming in the other direction, I slam on my brakes and slow to the speed limit. He turns around and then pulls me over at the next exit. He luckily gave me a ticket for 105. So I decide to contest the ticket since it is a madatory court appearence. The court was in Shafter, a small town next to Bakersfield and I lived in San Diego then so I wanted to take the least amount of trips there as possible. Anyway I ended up having to pay a little over $500 and had my license suspended for 2 weeks. The shitty thing was on the same trip I got another ticket back for going 83 at 2am in the morning.
You should have a chance contesting the ticket since your car can't go 130, but there are also many variables. Such as if you were going down hill or not, your wheel/tire combination and others.
